    The holder of this environmental authority must install all measures, plant and equipment necessary to ensure compliance with the conditions of this environmental authority and: (a) Maintain such measures, plant and equipment in a proper and efficient condition; and (b) Operate such measures, plant and equipment in a proper and efficient manner; and (c) Ensure all instruments and devices used for the measurement or monitoring of any parameter under any condition of this environmental authority are properly calibrated.     Any monitoring data, records and reports required by this environmental authority must be: (a) kept for a period of at least five (5) years; and (b) provided to a new holder of the environmental authority on transfer of the environmental authority; and (c) provided to the administering authority within a timeframe nominated by the administering authority; and (d) provided to the administering authority in the format requested.

    The following information must be recorded in relation to all monitoring required under the conditions of this environmental authority: (a) The date and time at which the sample was taken; and (b) The location or monitoring point at which the sample was taken; and (c) The results of all monitoring and details of any exceedances of the conditions of this environmental authority; and Permit Environmental authority P-EA-100119386 (d) Any other pertinent details of relevance to interpreting the sampling results (i.e. stream flow, wind conditions or any unusual observations such as odour or colouration).     The holder of this environmental authority must develop and implement a risk management system for mining activities which mirrors the content requirement of the Standard for Risk Management (ISO31000:2018), three (3) months prior to the commencement of mining activities.     The holder of this environmental authority must notify the administering authority by written notification within twenty-four (24) hours after becoming aware of any emergency, incident or exceedance relating to the release of contaminants not in accordance, or reasonably expected to be not in accordance with, the conditions of this environmental authority.

    Within ten (10) business days following the initial notification of an emergency, incident, exceedance, or receipt of monitoring results, whichever is the latter, further written advice must be provided to the administering authority, including the following: (a) results and interpretation of samples taken and analysed; and (b) outcomes of actions taken to prevent or minimise unlawful environmental harm; and (c) proposed actions to prevent a recurrence of the emergency, incident or exceedance.     The holder of this environmental authority must record all environmental complaints received about

    mining activities undertaken on the licensed place including: (a) Name, address and contact number of the complainant if provided; and (b) Time and date of complaint; and (c) Reasons for the complaint; and (d) Investigations undertaken; and (e) Conclusions formed; and (f) Actions taken to resolve the complaint; and (g) Any abatement measures implemented; and (h) Person responsible for actioning the complaint. The holder of this environmental authority must, when requested by the administering authority, undertake relevant specified monitoring within a reasonable timeframe nominated or agreed to by the administering authority to investigate any complaint of environmental harm. The results of the investigation (including an analysis and interpretation of the monitoring results) and abatement measures, where implemented, must be provided to the administering authority within ten (10) business days of completion of the investigation, or no later than ten (10) business days after the end of the timeframe nominated by the administering authority to undertake the investigation, whichever is the latter.     The holder of this environmental authority must: (a) Within one (1) year of the effective date of this environmental authority, obtain from an appropriately qualified person a report on compliance with the conditions of this environmental authority; and (b) Obtain further such reports at regular intervals, no less than once every three (3) years, from the completion of the report referred to in (a) above; and (c) Provide each report to the administering authority within ninety (90) days of its completion.

    Where a condition of this environmental authority requires compliance with a standard, policy or guideline and the standard, policy or guideline is amended or changed subsequent to the issue of this environmental authority, the holder of this environmental authority must: (a) comply with the amended or changed standard, policy or guideline within two (2) years of the amendment or change being made, unless a different period is specified in the amended standard, policy or guideline, or where the amendment or change relates specifically to regulated structures referred to referred to in this environmental authority, the time specified in that condition; and (a) until compliance with the amended or changed standard, policy or guideline is achieved, continue to remain in compliance with the standard, policy or guideline that was current immediately prior to the relevant amendment or change.     The holder of this environmental authority must develop, document and implement a waste management program for all mining activities at the licenced place in accordance with Part 5 of the Environmental Management (Waste Management) Policy 2000.

    The waste management program required under condition C4 must be regularly reviewed and updated at intervals of no greater than five (5) years. The program must include: (a) a description of the mining activity that may generate waste; and (b) waste management control strategies including: (i) recording of the types and amounts of wastes generated by the mining activity; (ii) segregation of the wastes; (iii) storage of the wastes; (iv) transport of the wastes; and (v) monitoring and reporting matters concerning the waste; and (c) the hazard characteristics of the wastes generated including disposal procedures for regulated wastes; and (d) a program for reusing, recycling or disposing of all wastes; and (e) how the waste will be dealt with in accordance with the waste and resource management hierarchy, including a description of the types and amounts of waste that will be dealt with under each of the waste management practices in the waste management hierarchy (i.e. avoidance, reuse, recycling, energy recovery, disposal); and Permit Environmental authority P-EA-100119386 (f) how the waste will be stored, handled and transferred in a proper and effective manner; and (g) procedures for identifying and implementing opportunities to minimise the amount of waste generated, promote efficiency in the use of resources and improve the waste management practices employed; and (h) procedures for dealing with accidents, spills, and other incidents that may impact on waste management; and (i) details of any accredited management system employed, or planned to be employed, to deal with the waste; and (j) how often the performance of the waste management practices will be assessed; and (k) the indicators or other criteria on which the performance of the waste management practices will be assessed; and (l) staff training and induction to the waste management program.     Within six (6) months of the effective date of this environmental authority and prior to the commencement of the mining activity, the holder of this environmental authority must develop, document and implement a Mine Material Management Plan, which includes: (a) a program of progressive sampling to validate pre-mine waste rock characterisation. The waste rock sampling program must include validation of salinity, acidity, alkalinity, dissolved metals, metalloids and non-metallic inorganic substances; and (b) geochemical kinetic testing must be conducted to indicate oxidation rates, potential reaction products and effectiveness of control strategies for acid mine drainage and neutral mine drainage potential; and (c) records must be maintained of all waste rock characterisation and disposal including contingency planning for the management of acid rock/neutral mine drainage; and (d) a materials balance and disposal plan demonstrating how waste rock that has a potential to generate neutral and/or saline mine drainage or is potentially acid forming and acid forming will be selectively placed and/or encapsulated to minimise the generation of acid or neutral mine drainage; and (e) how often the performance of the plan will be assessed; and (f) waste rock characterisation must be undertaken at a minimum rate of eight (8) regularly spaced samples per 100,000 tonnes of waste rock.

    Tailings must be managed in accordance with procedures contained within the Mine Material Management Plan required under condition C6. These procedures must include provisions for: (a) containment of tailings in accordance with the approved design plan(s); and (b) the management of liquid waste both during operation and post closure; and (c) the control of fugitive emissions to air; and (d) a program of progressive sampling and characterisation to identify non-acid and acid producing potential and metal concentrations of tailings that must include: Permit Environmental authority P-EA-100119386 (i) progressive characterisation of all tailings material during disposal for the following contaminants: arsenic, cadmium, chromium, copper, manganese, selenium, manganese, molybdenum, vanadium and zinc; and (ii) tailings characterisation must be undertaken at a minimum rate of eight (8) regularly spaced samples per 100,000 tonnes of tailings material discharged; and (iii) geochemical kinetic testing where the acid and neutral mine drainage producing potential of tailings material has not been conclusively determined to indicate oxidation rates, potential reaction products and effectiveness of control strategies; and (e) management of tailings in order to minimise the potential for environmental harm.     Temporary watercourse diversions must be designed and constructed to: (a) maintain the pre-existing hydrologic characteristics of the surface water system; and (b) maintain the hydraulic characteristics of the watercourse diversion that are equivalent to other local watercourses. Where structures that require on-going maintenance are used, they must not compromise the performance of the temporary watercourse diversion and adjoining watercourses; and (c) maintain sediment transport and water quality regimes that minimise any impacts to upstream and downstream water quality, geomorphology or vegetation; and (d) maintain the functionality of the substrate at the location of the diversion.

    In the event that a watercourse diversion application is lodged with the administering authority, a design plan must be submitted to the administering authority at least thirty (30) business days before commencing construction of a temporary watercourse diversion, that: (a) has been assessed and certified by a suitably qualified and experienced person; and (b) will achieve the required outcomes stated in condition I2.

    The hydraulic performance criteria specified in this environmental authority are the minimum mandatory performance requirements, regulated structures must be managed in a manner that ensures compliance with all conditions of this environmental authority. End of Conditions for Schedule J Permit Environmental authority P-EA-100119386 Schedule K - Definitions Key terms and/or phrases used in this document are defined in this section. Where a term is not defined, the definition in the Environmental Protection Act 1994, its regulations or environmental protection policies must be used. If a word remains undefined it has its ordinary meaning. `Acid rock drainage' means any contaminated discharge emanating from a mining activity formed through a series of chemical and biological reactions, when geological strata is disturbed and exposed to oxygen and moisture. `Administering Authority' is the agency that administers the environmental authority provisions under the Environmental Protection Act 1994. `Annual inspection report' means an assessment prepared by a suitably qualified and experienced person containing details of the assessment against the most recent consequence assessment report and design plan (or system design plan); a) against recommendations contained in previous annual inspections reports; b) against recognised dam safety deficiency indicators; c) for changes in circumstances potentially leading to a change in consequence category; d) for conformance with the conditions of this authority; e) for conformance with the `as constructed' drawings; f) for the adequacy of the available storage in each regulated dam, based on an actual observation or observations taken after 31 May each year but prior to 1 November of that year, of accumulated sediment, state of the containment barrier and the level of liquids in the dam (or network of linked containment systems); g) for evidence of conformance with the current operational plan. `Annual exceedance probability or AEP' means the probability that at least one event in excess of a particular magnitude will occur in any given year. `ANZG (2018)' means Australian and New Zealand Guidelines for Fresh and Marine Water Quality (2018). Published by the Australian and New Zealand Governments and Australian state and territory governments or any equivalent update/replacement guidelines. `ANZECC (2000)' means the Australian and New Zealand Guidelines for Fresh and Marine Water Quality (2000) published by the Australian and New Zealand Environment and Conservation Council and the Agriculture and Resource Management Council of Australia and New Zealand or any equivalent update/replacement guidelines. `Appropriately qualified person' means a person who has professional qualifications, training, skills or experience relevant to the nominated subject matter and can give authoritative assessment, advice and analysis on performance relating to the subject matter using the relevant protocols, standards, methods or literature. `Assessed or assessment' by a suitably qualified and experienced person in relation to a consequence assessment of a dam, means that a statutory declaration has been made by that person and, when taken together with any attached or appended documents referenced in that declaration, all of the following aspects are addressed and are sufficient to allow an independent audit of the assessment:
