    Condition (A1-3) is a condition that overrides the Code of Environmental Compliance for Mining Lease Projects condition 14 and prevails to the extent of any inconsistency.

    The holder of the environmental authority must not carry out activities: 1. in, or within 2km of, a category A environmentally sensitive area; or 2. in, or within 100m of, a category B environmentally sensitive area in relation to ML50026; or 3. in, or within 600m of, a category B environmentally sensitive area in relation to ML1195. Prior to carrying out activities in a Category C environmentally sensitive area, the holder of the environmental authority must consult with the relevant administering authority and the Department of Environment and Resource Management or its successor. If it is determined through the consultation that additional conditions are necessary, the holder must comply with those conditions. Where a definition for a term used in this EA is sought and the term is not defined, the definitions in the Environmental Protection Act 1994, its Regulations and Environmental Protection Policies, must be used.
