Where there is any inconsistency between that description of an ERA and the conditions stated by an environmental authority as to the scale, intensity or manner of carrying out an ERA, then the conditions prevail to the extent of the inconsistency. An environmental authority authorises the carrying out of an ERA and does not authorise any environmental harm unless a condition stated by the authority specifically authorises environmental harm. A person carrying out an ERA must also be a registered suitable operator under the Environmental Protection Act 1994 (EP Act). Permit Environmental Authority Obligations under the Environmental Protection Act 1994 In addition to the requirements found in the conditions of this environmental authority, the holder must also meet their obligations under the EP Act, and the regulations made under the EP Act. For example, the holder must comply with the following provisions of the Act: * general environmental duty (section 319) * duty to notify environmental harm (section 320-320G) * — offence of causing serious or material environmental harm (sections 437-439) ¢ offence of causing environmental nuisance (section 440) ° offence of depositing prescribed water contaminants in waters and related matters (section 440ZG) ¢ offence to place contaminant where environmental harm or nuisance may be caused (section 443) Conditions of environmental authority With the exception of any variations, the conditions of approval for this environmental authority include standard conditions contained within the attached document(s) entitled: e The code of environmental compliance for mining lease projects. Complaints Records must be kept of all environmental complaints received about the mining activities including the following details: - name, address and contact number for complainant; - time and date of complaint; - reasons for the complaint; - investigations undertaken; - conclusions formed; - actions taken to resolve complaint; - any abatement measures implemented; and - person responsible for resolving the complaint. Waste All general waste generated on site must be disposed of to the Chillagoe Landfill. All waste rock generated on site must be stockpiled in the designated area identified on Map 1. Land The residual void must not cause any serious environmental harm to land, surface waters or any recognised groundwater aquifer, other than the environmental harm constituted by the existence of

W11___ If the level of water in Ti Tree Cave fluctuates by more than 0.1m in a 7day period, dewatering and/or mining activities must cease immediately and the administering authority must be notified. W112 ‘All data derived from continuous monitoring of water levels in Ti Tree Cave must be forwarded to the administering authority at least once every 4 weeks prior to and during dewatering and mining. W13 Extraction of marble is authorised under this environmental to take place at any time. From December to April extraction of marble is only authorised if there is no dewatering.
